Rights and Responsibilities

Below is a more simplified list of our rights and responsibilities as members of this community. Please note this list is simplified and not exhaustive, but is meant to give you a simple list to refer to. If you have any questions, reach out to the board via the general contact form.

Rights

Access and Use: Homeowners have the right to access and use their Units, Yard Areas, and Common Elements within the Community.

Easements: Homeowners enjoy certain easements for utilities, stormwater drainage, and maintenance, repair, and replacement activities.

Unit Modifications: Homeowners can modify their Units but may need consent for material changes, such as dimensions, from Co-owners and mortgagees.

Telecommunications Services: During the Construction and Sales Period, homeowners may benefit from telecommunications services provided by the Developer and later by the Association.

Assignment of Developer's Rights: Developer can assign certain rights and powers to homeowners, subject to Township approval.

Responsibilities

Maintenance Fees: Homeowners are responsible for their proportionate share of expenses related to maintenance, repair, and replacement activities unless covered by a governmental agency.

Consent for Certain Changes: Material modifications to Units, Limited Common Elements, or responsibility for maintenance may require the written consent of Co-owners and mortgagees.

Developer's Exclusive Rights: During the Construction and Sales Period, the Developer holds exclusive rights to amend the Master Deed, especially for purposes such as facilitating mortgage financing.

Township Approval: Certain amendments and easements require Township approval, ensuring adherence to local regulations and the community's best interests.

Convertible Areas: Homeowners do not have the right to influence the conversion of Convertible Areas, and the decision rests solely with the Developer, subject to Township approval.

Termination of Community Project: Homeowners cannot terminate, vacate, revoke, or abandon the Community Project without the written consent of 80% of all Co-owners and Township approval.

Modification Restrictions: Homeowners cannot modify Unit dimensions or Limited Common Elements significantly without the consent of Co-owners and mortgagees.

Telecommunications Contracts: Homeowners cannot enter into contracts or grant easements related to telecommunications services without Developer (during Construction and Sales Period) or Association (thereafter) approval.

Assignment Restrictions: Homeowners cannot independently assign or transfer certain rights and powers granted to the Developer without Township approval.

Termination of Easements: Homeowners cannot terminate utility or other easements without the Developer's approval during the Construction and Sales Period.

Amendments without Developer's Consent: Homeowners cannot amend the Condominium Documents during the Construction and Sales Period without the Developer's written consent.

Developer's Use of Facilities: During the Construction and Sales Period, homeowners must allow the Developer, its successors, and assigns access to certain facilities within the Community Project as necessary for development and sales activities.
